2. Description of Service

HeadshotCraft provides an AI-powered platform that generates professional headshots from user-uploaded photos. The Service uses artificial intelligence technology to create professional-quality images suitable for business and professional use.

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion.

4. Credits and Payments

4.1 Credit System

• Each headshot generation requires 1 credit
• New users receive 3 free credits upon registration
• Credits can be purchased through our payment system
• Credits are non-refundable and non-transferable
• Credits do not expire unless your account is terminated

4.2 Payments

• All payments are processed securely through Stripe
• Prices are subject to change with notice
• All sales are final - no refunds except as required by law
• You are responsible for all applicable taxes

5. User Content and Photos

5.1 Your Responsibilities

By uploading photos, you represent and warrant that:

• You own the rights to the photos or have permission to use them
• The photos do not violate any third-party rights
• The photos do not contain illegal, harmful, or offensive content
• You are the person depicted in the photos (or have their consent)

5.2 Prohibited Content

You may not upload photos containing:

• Nudity or sexually explicit content
• Violence or graphic content
• Hate speech or discriminatory content
• Minors without parental consent
• Copyrighted material without permission
• Illegal or fraudulent content

5.3 License to Use

By uploading photos, you grant us a limited license to process and generate headshots using AI technology. We will not use your photos for any other purpose without your explicit consent.

6. Generated Headshots

6.1 Ownership

You retain ownership of the generated headshots. You may use them for personal or commercial purposes without attribution.

6.2 Quality and Accuracy

• AI-generated results may vary in quality
• We do not guarantee specific results or likeness accuracy
• Results depend on the quality of uploaded photos
• We are not liable for dissatisfaction with generated images

6.3 Storage

Generated headshots are stored for 30 days. After this period, they are automatically deleted. You are responsible for downloading and saving your headshots.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to reverse engineer or hack the Service
• Use automated systems to access the Service
• Resell or redistribute our Service
• Impersonate others or provide false information
• Interfere with the Service's operation

8. Intellectual Property

The Service, including its design, code, features, and content (excluding user-generated content), is owned by HeadshotCraft and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

9. Disclaimers

9.1 Service Availability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the Service at any time.

9.2 AI Technology

AI-generated results are not perfect and may contain errors or inaccuracies. We are not responsible for any consequences arising from the use of generated headshots.

10. Limitation of Liability

To the maximum extent permitted by law, HeadshotCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or malicious code
• Any errors or omissions in content
• Any user content or conduct

11. Indemnification

You agree to indemnify and hold harmless HeadshotCraft from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these terms, or infringement of any rights of another party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HeadshotCraft operates, without regard to conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits.
